Service Terms and Conditions

By signing a contract, you are signing a legally binding contract for the work to be performed.

This estimate is an approximation and is not guaranteed. The actual cost may change once all project elements are finalized or negotiated. Prior to any changes of cost, the client will be notified.

Services upon acceptance-We will perform the services described in this estimate. Any additional services requested by you and not included in this estimate will incur additional charges.

Schedule-The services will be completed and will be done in accordance with the schedule agreed upon. Back Creek Home & Yard agrees to complete the services within the timeframe specified in the agreement, and in accordance with the schedule agreed upon by both parties. The schedule will be determined at the beginning of the project and may be adjusted if both parties agree to the changes in writing. Back Creek Home & Yard will use their best efforts to ensure that the services are completed on time and to the agreed-upon standard. If unforeseen circumstances arise that may impact the schedule, the service provider will promptly notify the client and work with them to develop a revised schedule if necessary. Back Creek Home & Yard will provide regular progress updates to the clients to keep them informed of the status of the work.

Changes- Changes in the specifications, quantities, schedule or other aspects of the services that are requested or approved by you do not become binding unless accepted in writing. Any such changes may result in additional or increased charges, and you agree to pay such increased charges.

Payments-The Customer agrees to pay Back Creek Home & Yard the agreed-upon amount for the services rendered. 

● A 50% deposit will be required at the time of booking. This means that when the customer confirms that they would like to proceed with the job or service, they will need to pay 20% of the total cost upfront.

● Final payment is due upon completion of the services unless otherwise agreed upon in writing.

● In case of default on final payment, the Customer shall be liable for a penalty as allowed by the laws of the State of Delaware. (See below)

Deposit/ Cancellation Notice-Once an estimate is accepted and a deposit is made, the client has a 24-hour window to cancel without penalty. If the client cancels within 24 hours of accepting the estimate, the deposit will be fully refunded. However, if the client cancels after the 24-hour window has passed, the deposit will become non-refundable.

Default on Final Payment:

● In the event of default on final payment, the Customer shall be notified in writing about the outstanding balance and given a period of 7 days upon completion of the job to settle the payment.

● If payment is not received within the specified grace period, the Customer agrees to pay a late fee of 20% on top of the final balance. Back Creek Home & Yard reserves the right to pursue legal remedies to collect the outstanding balance, including but not limited to filing a lawsuit and recovering legal costs and fees.

Warranty and Liability:

● Back Creek Home & Yard warrants that the services provided will be performed in a workmanlike manner and in accordance with industry standards.

● The Customer agrees to inspect the completed work promptly upon its completion and notify Back Creek Home & Yard of any defects or concerns within 5 business days upon completion of service. 

● Back Creek Home & Yard shall not be held responsible for any damage or injury resulting from the use of faulty materials provided by the Customer or from the Customer's misuse of the completed work.

● The liability of Back Creek Home & Yard for any claims arising out of the services provided, whether in contract, tort, or otherwise, shall be limited to the total amount paid by the Customer for the specific services rendered.

Dispute Resolution: Any dispute arising out of or relating to this Agreement, or the services provided shall be resolved through negotiation in good faith between Back Creek Home & Yard and the Customer.

● If the dispute cannot be resolved through negotiation, either party may pursue legal remedies as provided by the laws of the State of Delaware.

Property Access- If applicable, the client agrees to authorize us on their property for the purpose of performing the services stated in this estimate. Client understands that although we try our best to provide you with an accurate time frame, there is no set timeframe for the completion of services and several visits to the property may be required. The time stated on your appointment is just an arrival window, we will be sure to contact you when we are on our way. 

Social Media- Client agrees to allow Back Creek Home & Yard to utilize any photos, descriptions, reviews, quotes, texts or videos of the property for marketing purposes.

Communications- By inquiring about our services or doing business with us, you are giving Back Creek Home & Yard your consent to receive notifications and messages (e-mail or text) regarding our promotions or services.
